Edward Jay Epstein: The Amanda Knox Circus -- Again

Amanda Knox, even while appearing on prime time television in America to promote her book Waiting to Be Heard, is facing yet another murder trial in Italy for a crime -- of which, in 2011, after spending four years in prison, she was found innocent by an Italian appeals court. In throwing out the murder case against her, that court declared that the prosecution's charges were "not corroborated by any objective element of evidence." The revival of the baseless charges against Knox, and the tabloid frenzy it will no doubt stoke, proceeds from a five-year-long judicial circus in Italy.

Amanda Knox's ordeal began on November 1, 2007 with the brutal murder of Meredith Kercher, a 21-year-old British exchange student, in a ground-floor flat in a cottage shared by four young women in Perugia, Italy. When police arrived the next morning, they found Kercher's body with several knife wounds, her clothing strewn around, and a broken window. They did not find a murder weapon. It was a holiday weekend; the seven other tenants of the cottage -- including four men in the basement flat -- all claimed to have been away on the night of the murder, including one other exchange student who was there when the police arrived: Amanda Knox. Knox, an angel-faced 20-year-old student from Seattle, Washington, told police that she had spent the night at the home of her new boyfriend Raphaele Sollecito. Sollecito, who was standing with her, confirmed her alibi.

While the police investigators had no immediate witnesses to the murder and no murder weapon, they had a blood-stained bedroom in which the coroner determined that the victim was sexually assaulted and stabbed to death. This crime scene was crucial to solving the case since as the great French criminologist Edmond Locard suggested nearly a century ago, even the most careful criminal is likely to leave behind a hair, clothing fiber, a fingerprint or other trace of himself or herself. The crime scene in Perugia contained more than enough such clues fully to identify the assailant. There were 14 identifiable fingerprints in the room, a palm print on the blood-stained pillow under the victim's body, a sneaker print in the blood on the floor. DNA of a person other than Sollecito or any other tenant was found inside Kercher's vagina and on her purse. (Kercher's money was missing from that purse.) All those clues were marks of a single individual, though it took over a month to identify him. He was Rudy Guede, a 20-year-old drifter from the Ivory Coast, who had broken into other homes in the area. Less than a week before the murder, Guede had even been temporarily detained by police in Milan for breaking into a nursery and stealing an 11-inch kitchen knife.

The crime scene could establish from Guede's fingerprints that he had been inside the victim's room, from his DNA inside Kercher's vagina that he had had sexual contact with her, and from his sneaker impression found on the floor in her blood, his palm print found in her blood on the pillow, and his DNA found on her purse, that he had been in the room after she was stabbed. His description, moreover, fit that of a black man whom two witnesses had seen on the street running away from the cottage that night

Shortly after the murder, Guede had fled to Germany. It took more than a month to capture him. He was then extradited to Italy, tried, and in October of 2008, convicted of both the sexual assault upon Kercher and Kercher's murder.

The belated identification of a local burglar as the intruder and sexual assailant did not, however, end the ordeal of Amanda Knox. In the interim, the chief prosecutor, Giuliano Mignini had developed a theory that Knox - whom he described as a "she-devil" -- had murdered her roommate and staged the evidence of a break-in. Knox had been imprisoned. For Mignini to abandon his "she-devil" theory, even after Guede's arrest, could prove an embarrassment. In an earlier, so-called "Monster of Florence case," he had already advanced a "Satanic theory" -- in which he attributed a string of unsolved murders to a Satanic cult who killed young women to use their body parts in black masses. His efforts in that pursuit of a non-existent cult resulted in him being criminally indicted for prosecutorial misconduct. (He was still under that indictment in 2007.) If his "she-devil" characterization of Knox were to fail as well, the prosecutor might be further discredited.

The solution Mignini now found was to expand the "she-devil" theory to include Guede, and to claim that Knox teamed up with Guede and her boyfriend to kill her flat mate after a sex game.

The initial crime scene investigation had not produced a shred of evidence that Knox had been in the room at the time of the murder. Under interrogation, Knox had, however, lied to police. She had falsely told them that she had witnessed the Congolese-born owner of a nearby bar, Patrick Lumumba, murder Kercher. Knox had worked part-time for that bar. Lumumba denied having ever been at the cottage. He was, nonetheless, arrested -- as were Knox and her boyfriend Sollecito. Lumumba was fortunate enough to have a solid alibi for the night of the murder. He was released. Knox repudiated her accusation. In her new book, Waiting to Be Heard, she says the accusation was a pure fabrication, induced by police intimidation.

The false statement makes Knox a liar, but not at all, by implication, a murderer. A recent study of criminal justice in the U.S. by law professor Brandon Garrett shows it is not uncommon for innocent people to lie under police pressure; indeed no fewer than 40 people out of 250 who were convicted and later exonerated by DNA evidence, had falsely confessed to crimes they did not commit.

In Knox's case, Italian prosecutors in their subsequent investigation did find two bits of DNA that could support a conspiracy theory. The first was taken from a knife found in Sollecito's kitchen and matched Knox's DNA. The second bit of DNA was taken from Kercher's bra clasp and matched Sollecitto's DNA. As it turned out, both DNA samples were later invalidated by the appeals court because of a serious flaw: the police technician who examined them had failed to change her lab gloves between examining DNA samples, raising the possibility of cross-contamination. That "evidence" was invalidated, leaving none. In the absence of any physical evidence against them, Knox and Sollecito were acquitted by the appellate court.

In Italy, prosecutors have the right to appeal an acquittal. On March 25, 2013, at the request to the prosecutor, a court of Cassation overturned the acquittal of Knox, ordering her to be tried again for a crime, which an appellate court had found there was absolutely no evidence that she committed. The United States Constitution, under its double jeopardy provisions, protects individuals from being retried for crimes of which they have been acquitted. It would be a violation of Knox's constitutional rights as a United States citizen to return her to Italy to be tried again. It would also, of course, be a travesty of justice for an Italian prosecutor to use her case as a means to revive a his reputation, as an advocate of Satanic and "she-devil" conspiracy theory.

Algeria president in France for tests after minor stroke

ALGIERS (Reuters) - Algerian President Abdelaziz Bouteflika was transferred to France for medical tests on Saturday night after suffering a minor stroke, Algeria's official news agency said.

Bouteflika, who has ruled over the North African oil and gas producer for more than a decade, had an "transient ischemic attack" or mini-stroke on Saturday but his condition was not serious, the APS agency said, quoting the prime minister.

The 76-year-old is part of an older generation of leaders who have dominated politics in a country that supplies a fifth of Europe's gas imports and cooperates with the West in combating Islamist militancy.

He has rarely appeared in public in recent months, prompting speculation about his health.

"The president felt unwell and he has been hospitalised but his condition is not serious at all," Prime Minister Abdelmalek Sellal was quoted as saying by APS.

The president was then moved to France, on the recommendation of his doctors.

Bouteflika and other members of Algeria's elite have controlled Algeria since it won independence from France in a 1954-62 war.

In the early 1990s, the military-backed politicians overturned an election which Islamists were poised to win and then fought a conflict with them in which about 200,000 people were killed.

They also saw off the challenge of Arab Spring protests two years ago, with Bouteflika's government defusing unrest through pay rises and free loans for young people.

Bouteflika has served three terms as president of the OPEC member and is thought unlikely to seek a fourth at an election due in 2014.

U.S. diplomatic cables leaked in 2011 said Bouteflika had been suffering from cancer but it was in remission.

More than 70 percent of Algerians are under 30. About 21 percent of young people are unemployed, the International Monetary Fund says, and many are impatient with the gerontocracy ruling a country where jobs, wages and housing are urgent concerns.

A transient ischemic attack is a temporary blockage in a blood vessel to the brain. it typically lasts for less than five minutes and "usually causes no permanent injury to the brain", the American Stroke Association said on its website.

Obama administration bypasses CISPA by secretly allowing Internet ...

Scared that CISPA might pass? The federal government is already using a secretive cybersecurity program to monitor online traffic and enforce CISPA-like data sharing between Internet service providers and the Department of Defense.

The Electronic Privacy Information Center has obtained over 1,000 pages of documents pertaining to the United States government?s use of a cybersecurity program after filing a Freedom of Information Act request, and CNET reporter Declan McCullagh says those pages show how the Pentagon has secretly helped push for increased Internet surveillance.

?Senior Obama administration officials have secretly authorized the interception of communications carried on portions of networks operated by AT&T and other Internet service providers, a practice that might otherwise be illegal under federal wiretapping laws,? McCullagh writes.

That practice, McCullagh recalls, was first revealed when Deputy Secretary of Defense William Lynn disclosed the existence of the Defense Industrial Base (DIB) Cyber Pilot in June 2011. At the time, the Pentagon said the program would allow the government to help the defense industry safeguard the information on their computer systems by sharing classified threat information between the Department of Defense, the Department of Homeland Security and the Internet service providers (ISP) that keep government contractors online.

?Our defense industrial base is critical to our military effectiveness. Their networks hold valuable information about our weapons systems and their capabilities,? Lynn said. ?The theft of design data and engineering information from within these networks greatly undermines the technological edge we hold over potential adversaries.?

Just last week the US House of Representatives voted in favor of the Cyber Intelligence Sharing and Protection Act, or CISPA ? a legislation that would allow ISPs and private Internet companies across the country like Facebook and Google to share similar threat data with the federal government without being held liable for violating their customers? privacy. As it turns out, however, the DIB Cyber Pilot has expanded exponentially in recent months, suggesting that a significant chunk of Internet traffic is already subjected to governmental monitoring.

In May 2012 less than a year after the pilot was first unveiled, the Defense Department announced the expansion of the DIB program. Then this past January, McCullagh says it was renamed the Enhanced Cybersecurity Services (ECS) and opened up to a larger number of companies ? not just DoD contractors. An executive order signed by US President Barack Obama earlier this year will let all critical infrastructure companies to sign-on to ECS this June, likely in turn bringing on board entities in energy, healthcare, communication and finance.

Although the 1,000-plus pages obtained in the FOIA request haven?t been posted in full on the Web just yet, a sampling of that trove published by EPIC on Wednesday starts to show just exactly how severe the Pentagon?s efforts to eavesdrop on Web traffic has been.

In one document, a December 2011 slideshow on the legal policies and practices regarding the monitoring of Web traffic on DIB-linked systems, the Pentagon instructs the administrators of those third-party computer networks on how to implement the program and, as a result, erode their customers? expectation of privacy.

In one slide, the Pentagon explains to ISPs and other system administrators how to be clear in letting their customers know that their traffic was being fed to the government. Key elements to keep in mind, wrote the Defense Department, was that DIB ?expressly covers monitoring of data and communications in transit rather than just accessing data at rest.?

?[T]hat information transiting or stored on the system may be disclosed for any purpose, including to the government,? it continued. Companies participating in the pilot program were told to let users know that monitoring would exist ?for any purpose,? and that users have no expectation of privacy regarding communications or data stored on the system.

According to the 2011 press released on the DIB Cyber Pilot, ?the government will not monitor, intercept or store any private-sector communications through the program.? In a privacy impact assessment of the ECS program that was published in January by the DHS though, it?s revealed that not only is information monitored, but among the data collected by investigators could be personally identifiable information, including the header info from suspicious emails. That would mean the government sees and stores who you communicate with and what kind of subject lines are used during correspondence.

The DHS says that personally identifiable information could be retained if ?analytically relevant to understanding the cyber threat? in question.

Meanwhile, the lawmakers in Congress that overwhelmingly approved CISPA just last week could arguably use a refresher in what constitutes a cyberthreat. Rep. Michael McCaul (R-Texas) told his colleagues on the Hill that "Recent events in Boston demonstrate that we have to come together as Republicans and Democrats to get this done,? and Rep. Dan Maffei (D-New York) made unfounded claims during Thursday?s debate that the whistleblowing website WikiLeaks is pursuing efforts to ?hack into our nation?s power grid.?

Should CISPA be signed into law, telecommunication companies will be encouraged to share Internet data with the DHS and Department of Justice for so-called national security purposes. But even if the president pursues a veto as his advisers have suggested, McCullagh says few will be safe from this secretive cybersecurity operation already in place.

The tome of FOIA pages, McCullagh says, shows that the Justice Department has actively assisted telecoms as of late by letting them off the hook for Wiretap Act violations. Since the sharing of data between ISPs and the government under the DIB program and now ECS violates federal statute, the Justice Department has reportedly issued an undeterminable number of ?2511 letters? to telecoms: essentially written approval to ignore provisions of the Wiretap Act in exchange for immunity.

"The Justice Department is helping private companies evade federal wiretap laws," EPIC Executive Director Marc Rotenberg tells CNET. "Alarm bells should be going off."

In an internal Justice Department email cited by McCullagh, Associate Deputy Attorney General James Baker is alleged to write that ISPs will likely request 2511 letters and the ECS-participating companies ?would be required to change their banners to reference government monitoring.?

"These agencies are clearly seeking authority to receive a large amount of information, including personal information, from private Internet networks," EPIC staff attorney Amie Stepanovich adds to CNET. "If this program was broadly deployed, it would raise serious questions about government cybersecurity practices."

Senate votes to move forward on bill taxing Internet sales

WASHINGTON (Reuters) - A measure to empower U.S. states to require out-of-state retailers to collect online sales tax cleared a legislative hurdle in the Senate on Monday, after earlier winning official backing from President Barack Obama.

Seventy-four senators voted to limit debate and move forward with a final vote on the proposed legislation in the Democratic-controlled Senate, likely on Wednesday.

"You have businesses all around America on Main Streets and shopping malls collecting sales tax on the things that they sell, competing with Internet retailers who do not," said Democratic co-sponsor Senator Richard Durbin.

Supporters of the measure include brick-and-mortar retailers such as Wal-Mart Stores Inc and Best Buy Co Inc and cash-strapped state governments, along with Amazon.com Inc, which hopes to simplify its U.S. state retail tax situation. Opponents include many online merchants, including eBay Inc and Overstock.com Inc.

Prospects for the bipartisan measure are murkier in the Republican-controlled House of Representatives, where some Republicans view it as a tax increase.

Lobbyists on both sides are working to make their case in Congress. Several new wrinkles emerged on Monday, a key one being that the Obama administration for the first time officially backed the measure.

White House spokesman Jay Carney said the bill "will level the playing field for local small business retailers who are undercut every day by out-of-state on-line companies."

Amazon, with its extensive network of distribution centers, already collects tax in nine states, and has agreements with seven more states to start charging in the next year. Amazon has been actively supporting the bill on Capitol Hill.

The bipartisan National Governors Association supports the tax, and in a letter to lawmakers on Monday said the disparate treatment of online and Main Street businesses is "shuttering stores and undermining state budgets."

For its part, eBay's chief executive launched a major lobbying blitz this week, pleading with its millions of users to oppose the effort.

WALL STREET WEIGHS IN

In a twist to the lobbying on the issue that has gone on for years, the Securities Industry and Financial Markets Association came out in opposition to the bill.

Representing big investment banks like Goldman Sachs Group, but also online companies like E*TRADE Financial Corp, SIFMA said the bill could lead to a state-level financial transaction tax and "unexpected" consumer costs.

Eleven EU countries are embracing a federal-level financial transaction tax on trading in stocks, bonds and derivatives. The Obama administration opposes such a tax for the United States.

The idea of imposing a financial transaction tax at the state level in the United States seemed unlikely to Verenda Smith, deputy director of the Federation of Tax Administrators.

She said she was not aware of any states that impose such a tax. "It's hard for a state to even broaden their sales tax to include hairdressers," Smith said. "I don't want to think how hard it would be to broaden to financial transactions."

Under current law, states can only mandate that online merchants with physical stores or affiliates within state borders collect sales tax. Consumers are supposed to pay the tax on their own, but few even know about this.

As a result, online-only retailers often have a pricing edge over bricks-and-mortar retailers in many markets.

Critics say it will create more complications, especially for small businesses, which may have to comply with conflicting state laws and new software.

"The bill has never been about helping Main Street but about helping Big Box stores," said Steve Delbianco, an official with a coalition of e-commerce companies called Netchoice.

The legislation would extend the authority of U.S. states to online sales outside their physical borders, though it would not require them to do so. It would exempt merchants with online annual out-of-state sales of $1 million or less.

"The reason the (banks) are nervous about it is they have managed to successfully argue against their services being taxed because it is so mobile," said Kim Ruben, an economist and director of state issues at the Tax Policy Center, a centrist think tank in Washington.

WEST, Texas (AP) ? From money, food and clothing to new appliances and crews armed with chain saws, help is pouring into the tiny Texas town where a fertilizer plant exploded.

As the donations come in, how long and how much it will take for West to come back aren't yet known.

Residents have just started burying the 14 people who died in last week's blast. Some don't yet know what happened to their homes. They're struggling to replace missing medications and documents.

Others are just starting to work with insurance companies to figure out how much money they'll get for repairs.

The explosion last Wednesday at West Fertilizer left a crater more than 90 feet wide and blasted the walls and windows off dozens of buildings in the town of 2,700.

Condition of 5-year-old Indian girl who was raped improves

NEW DELHI (AP) ? The condition of a 5-year-old girl who was raped, tortured and then left alone in a locked room for two days has improved, a doctor said, as protests continued in India's capital over the authorities' handling of the case.

The girl was in critical condition when she was transferred Thursday from a local hospital to the largest government-run hospital in the country. But D.K. Sharma, medical superintendent of the state-run hospital in New Delhi where the girl was being treated, said Sunday that she was responding well to treatment and that her condition had stabilized.

Police say the girl went missing April 15 and was found two days later by neighbors who heard her crying in a locked room in the same New Delhi building where she lives with her family. The girl was alone when she was found, having been left for dead by the man following the brutal attack, police say.

A 24-year-old man was arrested Saturday in the eastern state of Bihar, about 1,000 kilometers (620 miles) from New Delhi. After being flown to New Delhi, he was in custody Sunday and was being questioned, police said.

The attack came four months after the fatal gang rape of a woman on a New Delhi bus sparked outrage across India about the treatment of women in the country.

For the second consecutive day, hundreds of people protested Sunday outside police headquarters in the capital, angry over allegations that police had ignored complaints by the girl's parents that she was missing.

About 100 supporters of the main opposition Bharatiya Janata Party protested outside the home of the chief of the ruling Congress Party, Sonia Gandhi, demanding that the government ensure the safety and security of women and girls in the city.

The protesters also demanded that the Delhi police chief be removed from office and that police officials accused of failing to act on the parents' complaint be dismissed.

"Police and other officials that fail to do their jobs and instead engage in abusive behavior should know that they will be punished," Meenakshi Ganguly, South Asia director of New York-based Human Rights Watch, said.

Police said they detained more than 50 protesters when they tried to break down barricades on the road leading to Gandhi's house. The protesters were released after a few hours.

Police also placed restrictions on the gathering of more than four people on the main avenue in the heart of New Delhi after university students said they planned to hold a demonstration there. Despite the police order, about 100 students gathered at New Delhi's iconic India Gate monument and held a peaceful protest late Sunday.

Sexual crimes against women and children are reported every day in Indian newspapers, and women often complain about their sense of insecurity when they leave their homes.

Prime Minister Manmohan Singh called for changes in attitudes toward women in India, where there has been a fierce debate since December's fatal New Delhi gang rape about the routine mistreatment of females.

"The gruesome assault on the little girl a few days back reminds us once again of the need to work collectively to root out this sort of depravity from our society," Singh said Sunday at a meeting with civil servants.

A day earlier, Singh had urged Indian society "to look within and work to root out the evil of rape and other such crimes from our midst."

The fatal beating and gang rape of a young woman aboard a moving New Delhi bus sparked outrage and spurred the government to pass tough laws for crimes against women, including the death penalty for repeat offenders or for rape attacks that lead to the victim's death.

But activists say that merely passing strong laws is not enough, and that the government has to convey its intention to crack down on crimes against women to its officials and the police.

"Enacting strong laws are simply a first step, but it needs the government to focus urgently on implementation if it is serious about protecting children and other victims of sexual abuse," Human Rights Watch's Ganguly said.

Celebrities earn high income, pay low tax ? TalkVietnam

Topping the black list of the tax authorities is a female singer, who recently was the judge of a popular reality show. She is also an image representative for many major brands but she paid very low personal income tax. In 2009, this singer paid only VND37 million ($1,600) of tax, equivalent to VND3.1 million/month or the total income of around VND20 million ($1,000) a month.

It is ridiculous that her reputation is on the rise, her remuneration is increasing but her tax payment is reducing, from VN37 million in 2009 to VND30.6 million in 2010 and only VND8.1 million in 2011.

Another female singer who is also known as an MC, contestant of TV shows, and recently the judge of a TV reality show has not declared personal income tax since 2009. A very famous overseas Vietnamese comedian is also in the same situation.

According to the Ho Chi Minh City Tax Bureau, some singers declared personal income tax but they paid very low tax compared to their real income. For example, a male MC of many TV game shows paid very modest tax, VND18.8 million ($900) in 2009, VND27.8 million in 2010, and VND54 million in 2011.

As being revealed by the tax authorities, the highest tax that a top male singer in Vietnam paid in 2011 was only VND373 million ($18,000). The tax office did not accept that figure and asked the singer to declare his income again. Finally, he paid up to VND773 million ($33,000) of tax.

A folk singer declared personal income tax of only VND13.3 million ($600) in 2009 but the tax authorities requested her to declare income again. She had to pay additional tax of up to VND400 million ($20,000).

Ms. Le Thi Thu Huong ? Vice Director of Ho Chi Minh City Tax Bureau ? said in the past four years, the bureau assigned district tax departments to manage the collection of personal income tax of artists and this form of management did not work well. The bureau is collecting information of the income of artists in collaboration with show organizers, night clubs, etc.

Source: Case being built against ex-Texas official

KAUFMAN, Texas (AP) ? Texas authorities investigating the killing of a district attorney and his wife are working to build a case against a former justice of the peace prosecuted last year by the slain official's office, a law enforcement official said Monday.

Eric Lyle Williams, 46, was arrested over the weekend and remains jailed on a charge of making a terroristic threat. He is being held on $3 million bond.

Authorities allege he emailed an anonymous threat to law officers from his personal computer one day after Kaufman County District Attorney Mike McLelland and his wife, Cynthia, were found dead in their home on March 30. The email implied that if authorities didn't respond to various demands, there'd be another attack, according to a probable cause affidavit released by the sheriff's office.

Williams' arrest came after federal and local agents investigating the couple's deaths searched Williams' home and a storage facility, and investigators are now focused on trying to build a case against him, according to the law enforcement official, who spoke to The Associated Press on condition of anonymity because of the sensitivity of the ongoing investigation.

The official said at least 20 weapons found in Williams' storage locker are being tested by ballistics experts. A Ford Crown Victoria similar to one seen and video recorded in the McLellands' neighborhood on the day they died also was found at the locker, the official said.

A state law enforcement official spent two-and-half hours visiting with the storage facility's manager Monday. The official went into the manager's office with a small black duffel bag and left with the bag as well as what appeared to be several documents. The manager, Larry Mathis, declined to comment after the meeting.

The storage locker is located in Seagoville, about 15 miles west of Williams' home, where two signs on the front doors Monday instructed media seeking comment to contact David Sergi, Williams' attorney in the theft case. However, a woman who answered the phone at Sergi's office said he would not have any comment on the case Monday.

Authorities have said little about their investigation into the McLellands' deaths and have not named any suspects. Previous possible culprits mentioned included a white supremacist prison gang known as the Aryan Brotherhood of Texas, which had been targeted by a task force that included McLelland's office.

Two others have been arrested for making terroristic threats during the investigation into the slayings, but authorities said they had no connection to the deaths.

The McLellands were killed about two months after one of McLelland's prosecutors, Mark Hasse, was slain outside the local courthouse. McLelland and Hasse both participated in last year's prosecution of Williams on charges he stole three computer monitors from an office building.

Williams has said he submitted to gunshot residue tests and turned over his cellphone after both McLelland and Hasse were found dead.

Both prosecutors gave closing arguments before a jury convicted Williams last March. They questioned his character and suggested he was prone to threatening others. Williams received two years' probation, but lost his position as justice of the peace ? an elected judicial officer who typically handles smaller civil and administrative matters ? as well as his law license.

Williams has appealed the verdict, and on March 29 ? one day before the McLellands were found dead ? a state appeals court in Dallas agreed to hear oral arguments in the case.

Gift card as a tax refund: a good idea?

Recently, I was using TurboTax to do my taxes for the year. For the last several years, I?ve been paying in a bit each year rather than receiving a return because I?m self-employed, which means I have to handle my own personal taxes and I usually make my quarterly tax payments on the lower end of what?s reasonable.

Anyway, one of the things I usually do with TurboTax is that once my taxes are actually finished, I?ll play around with scenarios a bit. What would things look like if I made $10,000 less this year? Would I get a refund? What if we gave more to charity? How would that have affected things? It?s essentially a big personal finance calculator that?s already set up with all of our data, so it?s really useful for looking at things like that.

As I was doing this, I discovered something interesting. TurboTax has an offer embedded in it that will give you an Amazon.com gift card in lieu of your tax return. If you accept that, they?ll add an additional 5% to the balance of that card.

This isn?t the first time I?ve seen this type of ?gift card as payment? offer. Coinstar kiosks usually offer this type of arrangement, where you?ll get more ?value? in the form of a gift card than if you simply receive cash. A few banks, such as SmartyPig, also have options where you can receive the balance of your account in the form of a gift card with an additional ?bonus? added to the value of that card.

It?s an interesting offer, both for the institution making the offer and for the customer.

For the institution, they?re able to acquire gift cards from Amazon at a slight discount of their face value. Then, they pass along some of that value to the customer (keeping some of that difference

For the customer, it offers an additional option when receiving your payment, and choice is usually a good thing. The question really boils down to whether or not receiving a gift card as payment is really worth it for the customer.

The only time that you should consider a gift card as payment is if there?s significant additional value placed on the gift card and you?re actually going to use the card in the near future and you?re using the card for something reasonable.

Let?s break down these three elements.

First, is the gift card giving you additional value? If your choice is between cash and a gift card with the same face value, take the cash every single time. That?s obvious. The only time a gift card should be under consideration is if the face value of the gift card is higher than the cash option.

Most of the time, your gift card option will have a higher face value than the cash option. Most companies realize that most customers won?t go for the gift card without some incentive, so this aspect is almost a given.

Second, are you actually going to use the gift card in the near future? It?s very easy to put a gift card aside and forget about using it until you find it two years later (at which point, it might be expired). A forgotten gift card can easily be lost or thrown away on accident.

The best gift card is one you?re going to use quite quickly while it?s still fresh in your mind. Will you actually use that card in the near future? Or are you at risk of misplacing that card?

Finally, are you going to use the card for something reasonable? An Amazon gift card isn?t just an excuse to go buy random things. If you?re going to just blow the money on trivial things, it really doesn?t matter whether you choose the gift card or not.

If the presence of the gift card is tempting you to spend it on something purely useless, while the cash might be put to better use in your life, get the cash. If you can actually use the gift card for something worthwhile, such as buying household supplies or picking up a gift for someone, the card is probably a good choice.

If you?re not saying ?yes? to all three of these criteria, you should be getting your payment in the form of cash, not in the form of a gift card.

How to enable Guided Access on iPhone and iPad

The iPhone and iPad come native with lots of accessibility options that can make using them a lot easier for people with impairments. That isn't the only reason Apple gives many accessibility options though. Guided Access is a perfect example of how you can lock down an iPhone or iPad for use by children or even to create a guest user mode so others using your devices can't access things you don't want them to.

Follow along and we'll show you how to enable and start using Guided Access.

How to enable Guided Access on iPhone and iPad

  1. Launch the Settings app from the Home screen of your iPhone or iPad
  2. Tap on General.
  3. Scroll down towards the bottom of the screen and tap on Accessibility.
  4. Under the Learning section, tap on Guided Access.
  5. If it's not already, turn the toggle next to Guided Access to the On position.

That's it, Guided Access is now enabled and ready for you to use.

How to enter Guided Access mode

To enter Guided Access mode on your iPhone or iPad, just enter the app you'd like someone to be locked into and triple click the Home button. If you have multiple shortcuts set up for triple clicking the Home button, you'll be given the option to choose between them. Just tap on Guided Access. You'll now be launched into Guided Access mode and you can begin setting it up.

The Centers for Disease Control and Prevention does twice a year inspections of cruise ships. The latest report by the CDC shows 44 different problems on the Carnival ship Fascination, resulting in a score of 84. Ships are graded on a 100-point scale and anything below 86 is a failing grade.

USA Today first reported that "The inspectors found a number of violations on the Fascination including not enough chlorination at the ship's water park, salad bar items not protected by a sneeze shield and not enough lighting for cleaning in several food-related areas.

And then there were the flies. "At the hamburger grill, there was a large fly around the uncovered raw hamburger patties. The area was open during the inspection," according to the report.

A Carnival spokesman told USA Today that this was the first time a Carnival ship has failed a CDC inspection in five years. He said the average Carnival ship score during that same period was 97 out of 100.?

Meanwhile, Carnival and Sen. Jay Rockefeller, a West Virginia Democrat, and mixing it up over who pays rescue costs.

Carnival Corp. says all maritime interests must assist without question those in trouble at sea, a duty that would not include reimbursing the U.S. government nearly $780,000 for costs associated with the rescue of the crippled Triumph cruise ship.

Carnival released letters Friday replying to an inquiry by U.S. Sen. Jay Rockefeller, a West Virginia Democrat who chairs the Senate Commerce Committee, about the Triumph stranding and the cruise line's overall safety record. Among Rockefeller's questions was whether Carnival would repay the government for Coast Guard costs in the Triumph case as well as $3.4 million to the Coast Guard and Navy from the 2010 stranding of the Carnival Splendor in the Pacific Ocean.

"These costs must ultimately be borne by federal taxpayers," Rockefeller said in his March letter, adding that Carnival appears to pay little or no federal income taxes.

In response, Carnival said its policy is to "honor maritime tradition that holds that the duty to render assistance at sea to those in need is a universal obligation of the entire maritime community." The cruise line noted that its ships frequently participate in rescues at the Coast Guard's request, including 11 times in the past year in Florida and Caribbean waters. It did not make direct reference to repaying any money.

In fact, the Carnival ship? Conquest picked up 13 Cuban nationals about 40 miles (64 kilometers) from Key West on Friday. The ship was expected to rendezvous with a Coast Guard cutter near Key West to transfer them.

Crews on both ships provided their new passengers with food, water and medical attention. No injuries or deaths were reported.

And a Disney Cruise ship,? the Wonder, picked up eight people about 45 miles (72 kilometers) from Key West, but their nationality wasn't immediately known. The company was working with the Coast Guard to determine its next steps.

But in a statement, Rockefeller called the Carnival response to the request to pay US government rescue costs "shameful" and that he is considering "all options to hold the industry to higher passenger safety standards."

Those options could include a congressional hearing and legislation, perhaps even a closer look at taxation. Rockefeller's letter asked Carnival whether the money it pays in taxes covers the costs of various federal benefits it receives, a question the cruise line again did not directly answer. It did mention port taxes and fees and other payments and said it paid $16.5 billion in wages to U.S. workers in 2011.

"Every state where our ships call or home port benefits from the dollars spent by cruise lines to buy products and retain services from local businesses," Carnival added.

The exchange marked the latest chapter in the saga of the Triumph, which was disabled by an engine fire during a cruise in February in the Gulf of Mexico. Thousands of passengers and crew had to endure five days at sea with no power and under squalid conditions while the 900-foot vessel was towed to Mobile, Ala., where it continues to undergo repairs.

Rockefeller had asked Carnival for details about 90 incidents aboard its ships that were filed with the Coast Guard in the past five years. Carnival responded that 83 were not considered serious under federal regulations. Three were the Triumph and Splendor mishaps and the capsizing of the Costa Concordia off Italy's coast, which killed 32 people in January 2012. The others were more minor ship collisions, an illness and one passenger who jumped off a ship.

The cruise line said it takes each incident "very seriously" and undergoes reviews and corrective measures when needed, such as a review of safety and emergency response practices across all of Carnival's brands following the Concordia accident. In a separate letter, Carnival Chairman and CEO Micky Arison said the company takes the issues raised by Rockefeller very seriously.

"We remain committed to the safety and comfort of our guests and we are proud of our ability to provide millions of people with safe, fun and memorable vacation experiences," Arison wrote.

Take a closer look at Saturday?s ?The Ultimate Fighter? bouts

Now that we know Uriah Hall and Kelvin Gastellum are fighting in the final of "The Ultimate Fighter" on Saturday, it's time to look at the other TUF match-ups. As is the tradition, castmembers from the show will face off at the finale, though most of their bouts are on the preliminary card airing on Fuel. Whether you didn't watch the show or just forgot how it all went down, here's how each fighter did on the show.

Robert "Bubba" McDaniel vs. Gilbert Smith: This is the one bout that made the main card, and I'm not sure why. Smith was knocked out in his first round fight. McDaniel was choked out by by one finalist and knocked out by another. His one win came when Kevin Casey quit on the chair before the third round.

Kevin Casey vs. Josh Samman: Coming into the show, Casey was best known for filming a rap video with reality TV has-been Spencer Pratt. Now, he's known as the guy who lost to Collin Hart and then couldn't continue for a third round against McDaniel. He's taking on Samman, the semifinalist who was shocked by Gastellum.

Luke Barnatt vs. Collin Hart: Barnatt was on both ends of memorable knockouts. He took out Smith in the first round, but then was stopped by Dylan Andrews in the quarterfinals. Hart won in the first round with a decision over Casey, but was knocked out by Gastellum in the quarters.

Dylan Andrews vs. Jimmy Quinlan: It will be fun to watch Andrews fight again. As the last fighter picked, he was the surprise of the tournament with a first round decision win over Zak Cummings and a memorable third-round knockout of Luke Barnatt. He was finally stopped by the Hall buzzsaw, but will get another chance to show off his skills against Quinlan, who won his first round with a knockout of Tor Troeng, but was stopped by Samman in the quarterfinals.

Clint Hester vs. Bristol Marunde: Hester was Jon Jones' first pick, but lost in an upset when he was submitted by Quinlan in the first round. He's getting another chance to prove his potential in a bout with Marunde, a Strikeforce fighter who lost to Ronaldo Souza in his last bout.
